Include the Scottish devolved disability benefits in the LHA size-criteria benefit lists #2041
child disability payment (care component, middle or highest rate); Scottish adult disability living allowance (care, highest or middle); pension age disability payment; adult disability payment (daily living, standard or enhanced)
HB Regs 2006 reg 2(1), "person who requires overnight care" and "member of a couple who cannot share a bedroom"
all four
policyengine-uk has no variables for these benefits. A Scottish recipient counts only where the data records them as DLA, PIP or attendance allowance.
Task
Check how the enhanced FRS records ADP, CDP, PADP and Scottish adult DLA for Scottish respondents. The FRS benefit codes may differ by year.
Either add variables for them and include them in both lists (and the HB "cannot share" definitions), or document how the DWP variables stand in for them.
Cover the other provisions that list the same benefits, for example the UC carer element and the legacy premiums.
The Council Tax Reduction non-dependant exemption lists the same devolved benefits, so it belongs in this issue's "other provisions" too. No deduction is made for any non-dependant where the applicant or partner is blind or receives one of the listed benefits:
pension age disability payment; child disability payment (care); adult disability payment (daily living); Scottish adult DLA (care)
The model reads this in council_tax_reduction_applicant_has_non_dep_exemption (per claiming family with #2015). It checks blindness, attendance allowance, DLA care, PIP daily living and AFIP only, because the model has no variable for the devolved payments. Main had the same gap in council_tax_reduction_household_has_non_dep_exemption.
